Challenging a Deceased Estate

Unfortunately, the death of a loved one can often result in a challenge from a family member claiming that the deceased person did not leave the family member with an adequate and appropriate provision. Such a situation can create significant tensions within a family and that circumstance is coupled with what can be complex legal issues. When my mother died, I was devastated. She left her estate to me and my two sisters to be shared equally. But then, one of my sisters claimed that she should have received a larger share of the estate as she claimed she was impoverished and suffering from chronic illness. Fortunately, it was possible to resolve my sister’s claim without going to Court, but it was nevertheless a very distressing process having to deal with something that was totally contrary to our mother’s wishes. Family violence had been tearing my life apart for the last few years and when I decided to get away from my violent partner, I had no idea of the legal mess I was walking into. Anthony, I never want to go through that process again!
